- Website development services (done-for-you)
- AI-powered self-service website builder (via a white-label third-party platform)
We reserve the right to modify, suspend, or discontinue any part of our services at any time.
2. Eligibility
You must be at least 18 years old to use our services. By using our services, you confirm that you have the legal capacity to enter into this agreement.
3. User Accounts
To access certain services, you may be required to create an account.
You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Be responsible for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. AI Website Builder (Third-Party Platform)
Our AI website builder is powered by a third-party provider under a white-label arrangement.
By using this service:
- You acknowledge that parts of the service are delivered by a third party
- You agree that your data may be processed and stored by that provider
- You understand that uptime, performance, and features may depend on that provider
We are not liable for service interruptions or issues caused by third-party platforms, although we will make reasonable efforts to support and resolve issues.
5. SaaS Service Terms (AI Website Builder)
a. License to Use
We grant you a limited, non-exclusive, non-transferable license to use the AI website builder for your business or personal use.
b. Acceptable Use
You agree not to:
- Reverse engineer or attempt to extract source code
- Use the platform to build competing services
- Abuse system resources or interfere with other users
c. Availability and Uptime
We aim to provide reliable access to the platform; however:
- We do not guarantee 100% uptime
- Maintenance, updates, or third-party outages may impact availability
d. Data Portability
You may request access to your website content and data. Export capabilities may be limited depending on platform functionality.
e. Account Suspension
We may suspend or terminate access if:
- You violate these Terms
- Your usage creates risk to the platform or other users
- Required payments are not made
6. User Responsibilities
You agree not to use our services to:
- Violate any applicable laws or regulations
- Host or distribute illegal, harmful, or offensive content
- Infringe on intellectual property rights
- Transmit malware, spam, or malicious code
You are solely responsible for the content you create, upload, or publish using our services.
7. Website Content and Ownership
a. Self-Service Websites
You retain ownership of the content you create using the AI website builder.
However, you grant us a limited license to host, display, and process that content as necessary to provide the service.
b. Done-for-You Websites
Upon full payment:
- You own the final website deliverables
- We reserve the right to showcase completed work in our portfolio unless otherwise agreed in writing
c. Third-Party Assets
Some features, templates, or components may include third-party elements subject to their own licenses.
8. Payments and Billing
All fees for services will be clearly communicated before purchase.
You agree to:
- Pay all applicable fees on time
- Provide accurate billing information
For subscription services:
- Billing may recur automatically (monthly or annually)
- You may cancel according to the terms of your plan
Failure to pay may result in suspension or termination of services.
9. Refund Policy
Due to the nature of digital services:
- SEO services are non-refundable once work has commenced
- Done-for-you website services may be subject to milestone-based refunds (if specified in your agreement)
- AI website builder subscriptions are generally non-refundable unless required by law
Any exceptions will be outlined in writing.
10. SEO Services Disclaimer
You acknowledge and agree that:
- SEO results are not guaranteed
- Search engine rankings are influenced by factors outside our control, including algorithm changes, competition, and user behavior
- We do not guarantee specific rankings, traffic levels, or revenue outcomes
While we apply best practices and proven strategies, all SEO services are provided on a best-effort basis.
You further understand that:
- Results may take time and vary significantly between industries
- Past performance is not indicative of future results
11. Service Availability
We strive to provide reliable services, but we do not guarantee:
- Continuous or uninterrupted access
- Error-free performance
We are not responsible for downtime caused by:
- Third-party providers
- Internet service disruptions
- Events beyond our control
12. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- This includes loss of revenue, data, profits, or business opportunities
Our total liability is limited to the amount you paid for the service in the preceding 3 months.
Use of our services is at your own risk.
13. Indemnification
You agree to indemnify and hold harmless Abantu SEO and Abantu Tech Solutions Inc. from any claims, damages, or liabilities arising from:
- Your use of our services
- Your violation of these Terms
- Your content or actions
14. Termination
We may suspend or terminate your access to services if:
- You violate these Terms
- You fail to make required payments
- We are required to do so by law
You may terminate your use of services at any time, subject to applicable billing terms.
15. Privacy
Your use of our services is also governed by our Privacy Policy.
16. Changes to Terms
We may update these Terms from time to time. Continued use of our services after updates constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
